ผู้พิพากษากล่าว เราพิจารณาแล้วเห็นว่าบางส่วนของสัญญา ได้ทำลายซึ่งศีลธรรมอันดีของสังคมรวมถึงพื้นฐานการดำเนินงานในด้านธุรกิจ อันจะส่งผลให้สัญญาผูกมัดเป็นโมฆะ จนกว่าจะมีการให้คำตัดสินเป็นที่สิ้นสุด “เอสเอ็ม เอ็นเตอร์เทนเมนต์” จะไม่สามารถเข้าไปมีส่วนเกี่ยวข้องในกิจกรรมที่เป็นสิทธิเฉพาะของศิลปิน รวมถึงการเข้าไปควบคุมการทำกิจกรรมบันเทิงในด้านอื่น ๆ โดยมิได้รับคำยินยอมจากตัวศิลปินเอง อย่างไรก็ตามถ้ามีการตกลงแบบเฉพาะเจาะจงโอกาสให้การทำกิจกรรมในแบบกลุ่มอาจจะยังสามารถดำเนินต่อไปได้ สำหรับประเด็นกรณีส่วนแบ่งรายได้จากกิจกรรมที่มีอยู่ก่อนหน้านี้ การร้องขอให้ศาลตัดสินให้มีผลเป็นโมฆะนั้นยังค่อนข้างสรุปได้ยากส่งผลให้ผลการตัดสินในครั้งนี้ศาลจึงสั่งให้ยกเลิกสัญญาผูกมัดจากผู้ฟ้องร้องให้มีผลบังคับใช้

ด้านทนายความของ 3 หนุ่มเปิดเผยว่า “ทางเรารู้สึกขอบคุณในผลการตัดสินครั้งนี้เป็นอย่างมากครับ ในวันข้างหน้าหลังจากพวกเขาพักผ่อนอีกสักระยะสมาชิกดงบังชินกิ ก็จะพยายามทำงานกันอย่างหนักให้สมกับอิสรภาพในการทำกิจกรรมที่ได้รับในครั้งนี้ครับ ถึงแม้ว่าเราจะได้รับคำตัดสินให้มีผลสิ้นสุดเฉพาะในข้อสัญญาผูกมัดแต่เราก็รู้สึกว่าโชคดีมากแล้วครับเพราะการต่อสู้ในครั้งนี้เป็นอะไรที่หนักหนามาก ซึ่งก่อนหน้านี้เราก็ค่อนข้างเป็นกังวล แต่เมื่อได้ยินผลการตัดสินแล้วมันทำให้เรารู้สึกโล่งใจครับ”

ขณะที่ 3 หนุ่ม ดงบังชินกิ กล่าวว่า ถึงแม้ว่าเราจะรู้สึกดีใจในผลที่ได้แต่ตอนนี้เรายังไม่มีความคิดที่จะเริ่มทำกิจกรรมเดี่ยวครับ สำหรับในตอนนี้คงต้องให้คดีความสิ้นสุดอย่างเป็นทางการก่อนจึงจะสามารถวางแผนในการทำกิจกรรมต่อไปได้ ซึ่งจะมีการพูดคุยในรายละเอียดกันต่อไป ส่วนประเด็นอื่นในสัญญา เช่นเรื่องส่วนแบ่งรายได้และระยะเวลาสัญญายังไม่ได้มีการตัดสินออกมาให้ชัดเจน ซึ่งจริงๆแล้วเรื่องประเด็นปัญหาที่เราส่งเข้าไปในคำร้องนั้นเราก็อยากได้ศาลท่านมีคำสั่งบังคับใช้ด้วย และจนกว่าจะถึงตอนนั้นเราก็คิดว่าจะเตรียมตัวสำหรับคดีความต่อไป เราหวังว่าจะได้รับผลการตัดสินที่ดีกว่านี้ครับ

อนึ่ง 3 สมาชิกแห่ง ดงบังชินกิ ได้ยื่นคำร้องต่อศาลเพื่อให้สั่งระงับสัญญาเมื่อช่วงปลายเดือน ก.ค.ที่ผ่านมา โดยให้เหตุผลว่าระยะเวลาของสัญญาที่ยาวนานเกินไปกว่า 13 ปี รวมถึงส่วนแบ่งรายได้ที่ไม่เป็นธรรมกับทางต้นสังกัด “เอสเอ็ม เอ็นเตอร์เทนเมนต์” นั่นเอง.
